Will insurance pay for code upgrades when I rebuild?
Bringing a repair up to current building code is usually excluded, then partly restored by an ordinance-or-law clause with a fixed cap.
What filed forms generally say
The main exclusions in most forms rule out the increased cost of construction caused by an ordinance or law regulating construction or repair.
Many forms then add back a limited amount — frequently expressed as a flat dollar figure or a percentage of the dwelling limit — specifically for that increased cost.
The add-back generally applies only after a covered loss, not to voluntary upgrades.
Why your policy can still say something else
The restored amount is a specific number in your form or endorsement, and it is one of the figures endorsements change most often.
